1. Acceptance of Terms
Welcome to Picva. These Terms of Service govern your access to and use of Picva's websites, public SEO pages, admin dashboard, mobile applications, AI image generation tools, image editing tools, templates, prompt library, subscription services, and related features.
By accessing or using Picva, you agree to these Terms. If you do not agree, please do not use the Service.
2. About Picva
Picva is an AI image creation platform that helps users generate, edit, remix, and customize images using text prompts, uploaded reference images, templates, and AI models, including third-party image generation providers.
Picva is an independent platform and is not affiliated with, endorsed by, or sponsored by OpenAI. GPT Image 2 and related names belong to their respective owners.
3. Eligibility and Accounts
You must be at least 13 years old, or the minimum age required in your country, to use Picva. If you are under the age of majority, you may use Picva only with permission from a parent or legal guardian.
Some features require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. AI Image Generation and Editing
Picva allows you to create and edit images by submitting text prompts, images, style references, templates, and other instructions.
AI-generated results may be inaccurate, unexpected, incomplete, or visually inconsistent. You are responsible for reviewing any generated content before using, publishing, or distributing it.
Picva does not guarantee that generated images will be unique, copyrightable, legally protected, or suitable for a specific purpose.
5. User Content
User Content means any text, prompt, image, reference image, template, file, brand asset, logo, or other material that you upload, submit, create, or share through Picva.
You retain ownership of your User Content. By using the Service, you grant Picva a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify, display, and transmit your User Content solely as necessary to provide, operate, improve, secure, and support the Service.
You represent that you have all rights necessary to submit User Content and that your User Content does not violate any law, third-party rights, privacy rights, publicity rights, trademark rights, copyright rights, or these Terms.
6. Generated Output and Commercial Use
Subject to your compliance with these Terms and applicable laws, you may use images generated through Picva for personal or commercial purposes, depending on your subscription plan and the applicable license terms shown in the Service.
You are responsible for ensuring that your use of generated images does not infringe third-party rights or violate applicable laws. Picva does not provide legal advice and does not guarantee that any generated image is free from third-party claims.
7. Templates and Prompt Library
Picva provides templates, prompt examples, multilingual prompts, and style presets. Some templates may be created by Picva, while others may be created by users or third-party creators.
You may not copy, resell, redistribute, scrape, or use Picva templates or prompts to build a competing service without permission.
8. Public Pages, Demo Inputs, and Admin Tools
Picva may provide public pages, GPT Image 2 guide pages, template pages, prompt examples, and demo input areas that can be viewed before login. Demo inputs, search queries, and interactions on these pages may be processed to preview the Service, prevent abuse, measure performance, and improve Picva.
Access to the Picva admin dashboard, template management, prompt translation, moderation, publishing, and team tools is restricted to authorized users. You may not access, test, bypass, scrape, or interfere with administrative systems without permission.
9. Pro Subscription, Credits, and Paid Features
Picva may offer free and paid plans, including Pro, Team, and Enterprise plans. Paid plans may include higher generation limits, high-resolution export, watermark removal, commercial-use features, private templates, and priority processing.
Some features may consume credits. Credit usage, plan limits, and pricing may be displayed in the Service before purchase or generation.
10. iOS App Store Subscriptions and In-App Purchases
If you purchase a subscription or credits through the Apple App Store, your purchase is processed by Apple.
Auto-renewable subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your Apple Account settings.
Refund requests for App Store purchases are handled by Apple according to Apple's policies. Picva will provide app-side access to restore purchases, manage subscriptions, and request account deletion where required.
11. Cancellation and Refunds
You may cancel your subscription at any time. Cancellation will stop future renewals but will not automatically refund past charges.
For web purchases, refund eligibility may depend on the plan, usage, payment provider, and applicable law. For iOS in-app purchases, refund requests must be submitted to Apple.
12. Prohibited Uses
You may not use Picva to create, upload, edit, or distribute content that:
- violates any law or regulation;
- infringes copyright, trademark, publicity, privacy, or other rights;
- impersonates another person or misleads others;
- creates non-consensual intimate, sexual, or exploitative imagery;
- targets, exploits, or harms minors;
- promotes violence, self-harm, terrorism, fraud, or illegal activity;
- generates deceptive political, financial, medical, or legal content;
- attempts to bypass safety systems or usage limits;
- uploads private, confidential, or sensitive data without authorization;
- uses Picva to build or train a competing AI service without permission.
13. Third-Party Services and AI Providers
Picva may rely on third-party services for AI generation, cloud storage, analytics, payments, authentication, content moderation, and infrastructure.
Your use of Picva may involve processing by these third-party providers. Their terms and policies may also apply.
14. Content Moderation
Picva may review, filter, block, remove, or restrict content for safety, legal, policy, or quality reasons. We may also limit access to certain prompts, templates, uploads, or outputs.
15. Disclaimer and Limitation of Liability
The Service is provided as is and as available. Picva makes no warranties that the Service will be uninterrupted, error-free, secure, or that generated content will meet your expectations.
Generated content is for informational and creative purposes only and does not constitute financial, investment, legal, medical, or other professional advice.
To the maximum extent permitted by law, Picva will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages.
16. Termination and Account Deletion
We may suspend or terminate your access to the Service if you violate these Terms, create legal risk, misuse the Service, or fail to pay required fees.
You may stop using the Service at any time and may request account deletion through the app or by contacting us.
